Upaya Penyelesaian Non Performing Loan Pada Kredit Usaha Rakyat di Perbankan Indonesia

Abstract

Since the COVID-19 pandemic occurred, in addition to having an impact on public health, it has also had an economic impact, especially in Indonesia. In order to improve the economy in Indonesia, the government through President Joko Widodo is again promoting the unsecured loan system in the banking system, in order to avoid the backwardness of banking from fintech which is developing in the online loan system without collateral. So the government revived the people's business credit program (called KUR) which was issued by the government during the presidency of Susilo Bambang Yudhoyono, namely the unsecured KUR in Indonesian banks. Although in the provision of credit, in the event of a Non-Performing Loan, 70% of the payment will be claimed by the guarantor institution to the bank, but the bank must still apply the precautionary principle in granting credit to debtors because it is in the form of credit without collateral, the bank's position is as a concurrent creditor. In addition, in the event of bad credit, even though the insurance company will replace 70% of the credit to the bank, the bank still has to cover 30% of the credit, this can harm the bank which has an impact on the difficulty of the bank to redistribute credit to debtors. others who need capital for the development of their MSMEs, besides that the State as a pioneer of the KUR program will also experience losses because they have to replace insurance claims that have been paid by the insurance company, in addition to subsidizing bank interest in the KUR to the bank for 3%, the government must also be responsible to the insurance company for claims issued to the bank, in the event of a Non-Performing Loan. Finally, the government will find it difficult to distribute KUR to the community again, because it suffers a lot of losses in the case of Non-Performing Loans, in addition, it is feared that the government's goal to improve the country's economy after the COVID-19 pandemic, through the acceleration of MSMEs in Indonesia.

Abstrak

Sejak terjadi pandemi covid 19, selain berdampak terhadap kesehatan masyarakat juga memiliki dampak dari segi perekonomian khususnya di Indonesia. Dalam rangka memperbaiki perekonomian di Indonesia, pemerintah melalui presiden Joko Widodo kembali menggalakkan system pinjaman tanpa agunan di perbankan, guna menghindari ketinggalannya perbankan dari fintech yang berkembang dalam system pinjaman online tanpa agunan. Sehingga pemerintah menghidupkan kembali program kredit usaha rakyat (disebut KUR) yang pernah dikeluarkan oleh pemerintah pada masa presiden Susilo Bambang Yudhoyono, yaitu KUR tanpa jaminan di perbankan Indonesia. Meskipun dalam pemberian kredit tersebut,apabila terjadi Non Performing Loan, maka akan diklaim pembayarannya oleh lembaga penjamin kepada pihak bank senilai 70%, namun bank tetap harus menerapkan prinsip kehati-hatian dalam pemberian kredit kepada debitur karena dalam bentuk kredit tanpa agunan, maka kedudukan bank sebagai kreditur konkuren. Selain itu, apabila terjadi kredit macet, meskipun perusahaan asuransi akan menggantikan sejumlah 70% kepada pihak bank, namun bank tetap harus menutupi sejumlah 30% dari kredit tersebut, hal ini dapat merugikan pihak bank yang berdampak pada kesulitan pihak bank untuk menyalurkan kembali kredit kepada debitur lainnya yang membutuhkan modal untuk pengembangan UMKM nya, selain itu Negara sebagai pelopor program KUR tersebut juga akan mengalami kerugian karena harus mengganti klaim asuransi yang telah dibayarkan oleh pihak perusahaan asuransi, selain telah mensubsidi bunga bank dalam KUR tersebut kepada pihak bank senilai 3%, pemerintah juga harus bertanggung jawab terhadap perusahaan asuransi atas klaim yang dikeluarkannya kepada pihak bank, dalam hal terjadinya Non Performing Loan. Akhirnya pemerintah akan mengalami kesulitan untuk menyalurkan KUR kepada masyarakat kembali, karena mengalami banyak kerugian dalam hal terjadinya Non Performing Loan, selain itu, dikhawatirkan tidak tercapainya tujuan pemerintah untuk memperbaiki perekonomian Negara pasaca pandemic covid 19, melalui percepatan UMKM di Indonesia
