Abstract

Persecution is a mistreatment or an act of violence committed against a person or group of different ethnicity, religion, gender with the intention to humiliate, insult, and enslave the victim. Law enforcement against the crime of persecution uses articles of the Criminal Code that refer to the characteristics of the crime of persecution. The positive legal rules studied are sourced from the Constitution of the Republic of Indonesia (UU Tahunn1945) No. 39/1999 human rights and criminal law (KUHP). Criminal responsibility is a mechanism to determine whether or not a person can be held accountable for a criminal offense. Acts of violence classified as assault crimes are considered a violation of all human rights and can be classified as civil protection or illegal acts that result in the perpetrators being punished. From the point of view of criminal law, especially criminal law, these activities violate several articles with various cases of human rights violations, both individually and in groups.
