ANALISIS PERANAN MEDIATOR DALAM PROSEDUR MEDIASI (STUDI BERDASARKAN METODE PELATIHAN MEDIATOR DALAM LEMBAGA P4M)
Abstract
Mediation is an attempt to settle civil law matters outside of court through negotiation. The mediation method is carried out based on the consent of the parties who have consciously chosen conflict resolution by negotiation to establish a mutually beneficial agreement between the two without harming one of the parties or proceeding to court. Non-litigation techniques are typically used initially to resolve issues. The goal of mediation is to heal connections and trust that have been lost due to disagreements in the parties' civil relations, so that the parties may re-establish their harmonious relationship as before by using mediation. This study used a descriptive normative methodology, and modification was used to handle the data. When using qualitative analysis to analyze the data. The study's findings suggest that mediation should be conducted in a gentle manner so that it can truly affect the parties without having to resort to intimidation on the part of the mediator. It also demonstrates the importance of being able to comfort the disputing parties so that they know their concerns are being heard. As a result, the disagreeing parties are more willing and ready to participate in mediation processes so that the broken relationship may be enthusiastically repaired
